Mother 1/3 (33.33%) No children or siblings

Special Cases and Rules

Male vs Female Inheritance

Generally, male heirs receive twice the share of female heirs in the same category (e.g., sons vs daughters). This is because males have financial responsibilities for their families.

Charitable Bequests (Wasiyya)

Up to 1/3 of the estate can be allocated to non-heirs or charities. The remaining 2/3 must be distributed according to Islamic inheritance laws.

Debts and Expenses

Before any distribution, the following must be paid in order: 1) Funeral expenses, 2) Debts, 3) Wasiyya (up to 1/3), 4) Inheritance distribution.

Exclusions

Certain individuals cannot inherit: murderers of the deceased, non-Muslims (except in specific circumstances), and slaves (historically).

Siblings Inheritance (When No Children)

When Deceased Has No Children or Grandchildren

Heir Share Condition
Full Brothers Remainder after fixed shares When no sons
Full Sisters 1/2 if one, 2/3 if multiple When no brothers
Half Brothers (paternal) After full siblings No full siblings
Half Sisters (paternal) 1/2 if one, 2/3 if multiple No full siblings or brothers
